This Privacy Policy describes how DV Ocean Inc.(“DV Ocean,” “we,” “us,” or “our”), which operates the DV Ocean service (the “Service”), collects, uses, discloses, and protects information about you when you create an account, upload content, or otherwise interact with the Service.
By using the Service, you agree to the data practices described in this Policy. If you do not agree, please do not use the Service.
1. Information we collect
1.1 Information you provide
- Account information— your name, email address, and password credentials, collected and managed by our authentication provider (Clerk).
- Billing information— your payment method, billing address, tax identifiers, and transaction history. Card numbers and bank details are collected and stored by our payment processor (Paddle); we never see or store full card numbers.
- User content— audio files, scripts, generated videos, scene metadata, and any other materials you upload to or generate through the Service.
- Communications— messages you send to our support address or through the in-app contact form.
1.2 Information we collect automatically
- Usage data— render job timing, scene counts, model selections, API call counts, and per-job cost telemetry, used for billing and debugging.
- Device and log data— IP address, browser type, operating system, referring URLs, and timestamps of requests.
- Cookies and similar technologies— strictly necessary cookies for authentication and session management. We do not use advertising or cross-site tracking cookies. The cookie preferences banner stores your choice locally in your browser and keeps optional browser diagnostics disabled unless you allow them.
1.3 Information from third parties
If you sign in through a third-party identity provider, we receive the profile fields that provider releases to us (typically: email address, display name, and a stable identifier). We receive billing-status webhooks from Paddle when you subscribe, upgrade, or cancel a plan.
2. How we use your information
We use the information described above to:
- Operate, maintain, and run the video generation pipeline you request;
- Meter usage against your subscription plan, bill you accurately, and prevent abuse of per-job and per-month quotas;
- Authenticate you, secure your account, and protect the Service from fraud, abuse, and unauthorized access;
- Communicate with you about your account, render outcomes, billing events, security incidents, and material changes to the Service;
- Investigate bugs, performance issues, and incidents reported through server-side diagnostics, optional browser diagnostics after consent, or our structured logs;
- Improve the Service using aggregated, de-identified metrics (we do not use the contents of your uploads or generated outputs to train third-party AI models);
- Comply with our legal obligations and enforce our Terms of Service.
3. Legal bases for processing (EEA / UK users)
If you are located in the European Economic Area, United Kingdom, or Switzerland, we process your personal data on the following legal bases: (a) performance of our contract with you (to provide the Service you signed up for); (b) our legitimate interests in operating, securing, and improving the Service; (c) compliance with legal obligations; and (d) your consent, where required.
4. How we share information
4.1 Subprocessors
We share information with vetted third-party service providers (“subprocessors”) who process data on our behalf to operate the Service. The full current list is available on our subprocessors page. We require subprocessors to provide a level of protection comparable to the standards in this Policy.
4.2 Legal and safety disclosures
We may disclose information when we believe in good faith that disclosure is necessary to (a) comply with applicable law, subpoena, or court order; (b) protect the rights, property, or safety of DV Ocean, our users, or the public; or (c) investigate or respond to suspected fraud, security incidents, or violations of our Terms.
4.3 Business transfers
If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify affected users by email before any such transfer becomes effective.
4.4 We do not sell your personal information
We do not sell, rent, or trade your personal information to third parties for their marketing purposes. We do not share the contents of your uploads or generated outputs with anyone other than the subprocessors strictly required to render and deliver them.
5. International data transfers
DV Ocean is based in the United States, and the subprocessors we rely on operate servers in the United States and other countries. By using the Service, you understand that your information will be transferred to, stored in, and processed in the United States and other jurisdictions whose data protection laws may differ from those in your country.
6. Data retention
- Account data is retained for as long as your account is active and for up to 90 days after deletion for security and audit purposes.
- Uploaded audio and generated videosare retained according to your plan’s retention window. Free-tier outputs are retained for 7 days; paid-tier outputs are retained for 30 days unless you delete them sooner. Generated outputs are permanently deleted from storage shortly after the retention window expires.
- Billing records are retained for the period required by tax and accounting law (typically 7 years in the United States).
- Security and audit logs are retained for up to 180 days to support incident investigation.
7. Your rights and choices
Depending on where you live, you may have the following rights with respect to your personal information:
- The right to access a copy of the information we hold about you;
- The right to correct inaccurate or incomplete information;
- The right to deletion (“right to be forgotten”);
- The right to data portability (export);
- The right to object to or restrict certain processing;
- The right to withdraw consent where processing is based on consent.
To exercise any of these rights, email legal@aivideoediting.com from the address associated with your account. We will respond within 30 days. You also have the right to lodge a complaint with your local data protection authority.
8. Security
We implement reasonable administrative, technical, and physical safeguards designed to protect your information, including encryption in transit (TLS), encryption at rest for stored content, access controls scoped to per-tenant boundaries, secrets management for third-party API keys, and audit logging. No method of transmission or storage is 100% secure, however, and we cannot guarantee absolute security.
9. Children’s privacy
The Service is not directed to children under 13 (or under 16 in the EEA / UK), and we do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
10. California privacy rights (CCPA / CPRA)
California residents have the right to know what categories of personal information we collect, the sources and purposes of collection, the categories of third parties with whom we share it, and to request deletion or correction. We do not sell or “share” personal information for cross-context behavioral advertising. To submit a verifiable consumer request, email legal@aivideoediting.com.
11. Changes to this Policy
We may update this Policy from time to time. If we make material changes, we will notify you by email and update the “Last updated” date at the top of this page at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Policy.
